Maybe I do not understand its purpose...
Because the Game itself is inconsistent, you can be marauder with higher fame than -50, and nations officially are against marauders... so makes no sense that marauders can just freely walk around in cities. And this actually makes it so that they can still wander around if no player 'reports' them, which is really awesome!

Because societies are every changing. They see a threat, they react to said threat. If they don't, they become harmed, and eventually either get taken over or die. It's only natural that a game such as Ryzom would evolve to react to threats.
Unless I miss the point of this feature, my answer is still the same. Inconsistency makes the game less accessible. Exceptions make mess.
Why -40? Why not -45 or -25? Why not -50 as you could expect?
The point of the feature is that a marauder can't just wander around cities alone, it makes no sense gameplay and roleplay wise, since they are supposed to be enemies of the nations. Before they could since guards are 'lazy', and only aggro at -50, but maras can have -48 or -47, don't remember exactly.
The gong gives the option to players to alert the guards, if a marauder just walks around in the city alone, while still leaving raids on the cities possible, since guards don't get really stronger and groups of marauders can still kill guards.
