If the graphics aren't made with 3Dmax there is no need for conversion of licence. Also There are many graphics currently made on open game art. also 3d enviroments can be simulated in a 2d enviroment. It would need to be viewed form the top veiw for this. hills could be simulated with color depth and a simple dot for the characters gettin smaller if they go down hill or larger if going up hill.
