Are you really saying "Linux" is not trademarked? True it's open source, but it is trademarked.
I tried to find a proper source and found this:
"The registered trademark Linux® is used pursuant to a sublicense from the Linux Foundation, the exclusive licensee of Linus Torvalds, owner of the mark on a world-wide basis."
